New Illinois workplace legislation impacts business owners
The Illinois General Assembly, in its 2005 session, passed legislation that impacts Illinois employers.
One of these is the Illinois Family Military Leave Act, which now provides guaranteed unpaid leave for the employees of qualifying employers, with a protected right of return and protection of employment benefits during the leave. Every employer with 15 or more employees should review its own leave procedures, preferably with their attorney, to ensure compliance.
In addition, the Day and Temporary Labor Services Act was substantially revised and expanded to include specific private rights of action and provisions prohibiting retaliation. Potential penalties under Department of Labor enforcement are widely increased.
Hotel workers in Cook County are given new rights under the One Day Rest in Seven Act. Those who work at least seven hours are to receive two paid 15-minute breaks per shift, plus an unpaid 30-minute meal break, and a break room must be provided. Records of each person's break periods are also required. Additionally, it is unlawful for an employer who takes action against any person in retaliation for exercise of the newly-created rights.
